U.S. District Judge Jesse Furman ruled Monday that the Justice Department unlawfully fired Maurene Comey, a former assistant U.S. attorney in the Southern District of New York.
The judge ordered retroactive reinstatement and back pay effective from her July 2025 termination through December 20, 2025, when she began a new job.
Furman wrote that the firing violated the separation of powers and Comey's Fifth Amendment due process and statutory rights.
Comey had worked on prosecutions including those of Sean "Diddy" Combs, former Sen. Bob Menendez, Jeffrey Epstein and Ghislaine Maxwell.
The Justice Department did not immediately respond to a request for comment.
